    The USA Patriot Act gave law enforcement and intelligence agencies the resources they need in order to coordinate a campaign against terrorism (justice.gov, 2004, 1). It allowed for greater ability to gather, analyze, and share information that was critical to counter-terrorism intelligence. One issue than can arise as a result of this legislation is racial profiling, which means that individuals are stopped, searched, or exposed to other law enforcement tactics due solely to their race or ethnicity (Sutherland, 2005). This is wrong because it is not only a waste of valuable investigative time and resources, but it is a violation of civil rights. It will undermine the credibility of the law enforcement process and can decrease confidence of citizens in the criminal justice system. Racial profiling is also a violation of the Constitution. This issue was addressed in The Department of Justice’s Guidance Regarding the use of Race by Federal Law Enforcement Agencies. In this Guidance, it is made clear that racial profiling is wrong and that race cannot be used as a sole basis for law enforcement officers. More restrictions were placed on the use of race in federal law enforcement than the Constitution requires. Another issue is the reliance on stereotypes, which is forbidden in all cases (Sutherland, 2005). There is a difficult balance between using all available tools to protect the country from attack while honoring the laws of non-discrimination. In order to make this clearer, the Guidance information has been placed into policy manuals, is taught at training academies, and communicated to all personnel.
